Last Updated: October 29, 2026

Orange Tape, LLC (“Orange Tape,” “we,” “us,” or “our”), 13214 NE Whitaker Way, Portland, OR 97230, operates the Habitat Skateboards website (the “Site”). This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information through the Site, orders, communications, customer service, and related activities. We are the controller of personal information for the purposes described here unless otherwise stated. This policy applies to our customers and visitors, including residents of California, the European Economic Area (“EEA”), and the United Kingdom (“UK”).

1. PERSONAL INFORMATION WE COLLECT

Depending on your interaction with the Site, we may collect:

• Identifiers and contact information: name, mailing, billing and shipping addresses, email address, phone number, IP address, account identifiers and device/cookie identifiers.

• Account information: account profile and authentication information. Our ecommerce/authentication providers may process passwords or authentication credentials; we do not represent that we directly store readable passwords.

• Commercial information: purchases, returns, payment status, cart activity, products viewed, customer-service history, and preferences.

• Payment information: billing and transaction details. Payment card data is processed by payment providers; we do not intend to store complete payment card numbers in our ordinary systems.

• Internet and device activity: page views, referring pages, browser/device details, clicks, interactions, advertising identifiers, cookies and similar technologies.

• Approximate location based on IP address; we do not intentionally request device-level precise geolocation through the Site.

• Communications and content: customer inquiries, reviews, survey responses, and any materials you choose to submit.

• Inferences concerning product interests and preferences inferred from the above.

We collect information directly from you, automatically from your device and interactions, and from service providers, ecommerce and payment partners, carriers, analytics companies, and advertising partners. Some fields are required to complete purchases; if you do not provide them, we may not be able to fulfill an order or respond to a request.

2. HOW AND WHY WE USE INFORMATION

We use personal information to process orders, payments, delivery, returns and refunds; manage accounts; communicate about orders and security; provide customer service; prevent fraud and protect systems; maintain and improve the Site; analyze performance; comply with legal obligations; enforce applicable terms; maintain accounting records; and, where legally permitted, deliver and measure marketing and personalized advertising. We do not use personal information for materially incompatible new purposes without providing applicable notice and obtaining consent where required.

3. DISCLOSURE OF INFORMATION

We may disclose information to:

• Service providers and processors handling ecommerce hosting, payment, fraud screening, fulfillment, shipping, customer support, email/SMS, analytics, hosting, security, and technical services, subject to appropriate contractual protections.

• Advertising and social-media partners that receive identifiers, commercial activity or online activity through pixels, cookies or other integrations, where enabled and permitted by consent and opt-out choices.

• Corporate affiliates under common ownership or control, for purposes consistent with this notice and applicable law.

• Courts, regulators, law enforcement, advisors or others as needed for legal obligations, rights, safety or security.

• Purchasers or successors in a merger, reorganization or sale of business assets, subject to applicable protections.

• Other recipients with your instruction or consent.

We do not sell personal information for money. Advertising and cross-context behavioral advertising disclosures may nevertheless constitute a “sale” or “sharing” under California law or targeted advertising under other state laws. The categories potentially involved are identifiers, commercial information, approximate location derived from IP, and internet/device activity. We do not knowingly sell or share the personal information of people under 16. We do not disclose SMS opt-in consent information to third parties for their independent marketing; necessary messaging service providers may process it to deliver messages.

4. COOKIES, ANALYTICS AND ADVERTISING

Essential cookies support cart functions, authentication, checkout, security and site operation. Optional analytics, advertising and personalization tools may measure performance, recognize browsers, or show relevant advertising elsewhere. Our Site provides a cookie preference control. Where EEA/UK law requires consent, nonessential cookies and similar device-access technologies will not operate before a valid choice; you may withdraw consent through the preference control. You may also manage cookies in your browser, though some Site features may be affected. A current list of cookie categories, purposes and retention should be available in the preference tool or linked cookie information.

5. CALIFORNIA AND US STATE PRIVACY CHOICES

Subject to applicable law, you may request to know/access, correct, delete, or obtain a portable copy of personal information; opt out of sale/sharing and targeted advertising; and appeal a denied request where an appeal right exists. You will not be discriminated against for exercising rights; lawful price or service differences and other permitted exceptions may apply.

You may exercise advertising opt-out rights through the “Your Privacy Choices” or “Do Not Sell or Share My Personal Information” link in the Site footer. We also process legally applicable opt-out preference signals such as Global Privacy Control (GPC), for the relevant browser/device and associated profiles as required by law. You do not need an account to use these opt-outs. We provide a way to confirm your opt-out status.

To exercise other rights, email hello@habitatskateboards.com or write to our address above with “Privacy Request” in the subject. We may reasonably verify identity and, where permitted, confirm an agent’s authorization. We respond within the deadlines required by the applicable law; California requests are generally handled within 45 days, subject to permitted extension and applicable exceptions. If a state-law appeal is available, email hello@habitatskateboards.com with “Privacy Request Appeal”; we will respond within that state’s required period and explain further complaint options if an appeal is denied.

California notice at collection: categories collected, sources, purposes and recipient categories are described in Sections 1–3, retention in Section 7, and sale/sharing and opt-out choices in this Section and Section 3. If additional information is collected in a new context, a separate just-in-time notice may be provided. Our collection, use, disclosure, sale and sharing practices over the previous 12 months are described in the applicable categories above, to the extent those activities have occurred. We use any sensitive information, such as credentials or payment information, for permitted operational, security and transaction purposes rather than to infer characteristics about consumers. A separate “limit” option will be provided if our actual practices require it. Oregon residents may also request information about specific third parties to which information has been disclosed, as applicable.

6. EMAIL AND TEXT COMMUNICATIONS

Marketing emails and texts are sent where consent or another lawful basis exists. Creating an account or purchasing a product does not, by itself, mean you consent to marketing where consent is required. You can unsubscribe from marketing emails using the message link and opt out of texts by replying STOP or contacting us. We may still send necessary transactional messages. If the Site offers abandoned-cart messages, we send them only where permitted and with any required consent. Marketing consent records are maintained as needed to evidence choices and honor opt-outs.

7. DATA RETENTION

We retain personal information only for as long as reasonably necessary for the relevant purpose and legal requirements. Order, financial and tax records may be retained for approximately seven years or as otherwise legally required; account records ordinarily last while the account is active and for a limited period afterward; support records are retained according to business and dispute needs; marketing consent and suppression records are retained to honor choices; and cookie, analytics and advertising data follow the applicable tool settings and retention schedule. Relevant factors include legal recordkeeping duties, transaction needs, disputes, security and the age of the record. When no longer needed, we delete or de-identify information, subject to legal exceptions.

8. SECURITY

We use reasonable administrative, technical and organizational safeguards designed to protect information. No online system is completely secure. Contact us if you suspect unauthorized account activity.

9. CHILDREN

The Site is not directed to children under 16, and we do not knowingly collect information from them. If we learn we have collected such information without an appropriate legal basis or required permission, we will delete it as legally required. Contact us if you believe a child provided information.

10. EEA AND UK PRIVACY INFORMATION

Legal bases: We process order, delivery, payment, account and related customer-service data where necessary to perform a contract or take requested pre-contract steps; regulatory and tax records where necessary for legal compliance; fraud prevention, site security, support and necessary service improvements based on legitimate interests balanced against individuals’ rights; and nonessential cookies, certain analytics, personalized advertising, and electronic direct marketing on consent where required. In limited circumstances other lawful bases may apply and will be explained when relevant.

Your rights: Subject to limitations, you may request access, correction, erasure, restriction, portability, object to processing (including direct marketing and processing relying on legitimate interests), and withdraw consent at any time without affecting prior lawful processing. We ordinarily respond within one month, subject to lawful extensions. You may complain to your EEA data protection authority or the UK Information Commissioner’s Office. We do not intend to make decisions based solely on automated processing that produce legal or similarly significant effects about customers.

International transfers: Information may be processed in the United States and other countries. Where legally required for EEA/UK transfers, we rely on applicable adequacy decisions (including a recipient’s valid participation in an applicable data privacy framework), appropriate standard contractual clauses/UK transfer instruments, or another lawful transfer mechanism, together with required safeguards. Contact us to request further details or copies of relevant safeguards, subject to redactions.

Orange Tape’s primary privacy contact remains hello@habitatskateboards.com.

If we rely on legitimate interests, you may contact us to obtain more information about those interests and raise an objection.

11. CALIFORNIA-SPECIFIC ADDITIONAL DISCLOSURES

In the past 12 months, categories potentially collected are those listed in Section 1. Sources, business/commercial purposes and recipients are those described in Sections 1–3. The categories potentially sold/shared for cross-context advertising are identifiers, commercial information and internet/device activity. Whether a specific category is actually sold/shared depends on the tags and services active on this Site and your choices. We do not knowingly sell/share data about consumers under 16.

12. CHANGES

We may update this policy by posting a new version with a revised date. We will provide additional notice of material changes when legally required. We review this notice at least annually.
